General terms of sale
Last updated: 7 October 2026
This English translation is provided for convenience. In the event of any discrepancy, the French version prevails.
These terms apply to every order placed from the update date shown at the top of this page.
1. Purpose and scope
These general terms of sale (“Terms”) govern sales of products concluded between TERRE & CRÉATIONS (“Instant T”, “we”), whose details appear in the legal notice, and any individual or legal entity (“the customer”) placing an order on instant-t.ma or at the studio.
They are drawn up in accordance with Law No. 31-08 on consumer protection measures. Placing an order constitutes acceptance of these Terms. Customers may read, save and print them before ordering.
2. Products
We offer indoor plants, botanical creations and arrangements (terrariums, kokedamas, compositions), potting mixes, plant food and care products, accessories and planters, some of them made by local artisans. Each product is presented with its essential characteristics and its price.
Plants are living things: their size, foliage, colour or number of stems may vary slightly from one plant to another. Photographs illustrate the product but are not contractually binding. Arrangements are made by hand: two arrangements of the same design may differ in their details.
Quantities are limited. If a product turns out to be unavailable after you order, we will let you know straight away and offer you an equivalent product or the cancellation of your order, at no cost.
3. Prices
Prices are shown in Moroccan dirhams (MAD), including tax. They do not include any delivery charges, which are shown before the order is confirmed. The applicable price is the one displayed at the time of ordering. Promotional prices are valid while stocks last.
4. Orders
The customer selects products, adds them to the cart, enters their details and submits the order. Submitting the order constitutes an order request. The sale is concluded when we confirm the order to the customer by phone, WhatsApp or email. This confirmation allows us to check product availability and agree on how the order will be handed over.
The customer guarantees that the information they provide is accurate. We reserve the right to refuse or cancel an order for a legitimate reason, in particular where information is incorrect or a product is unavailable.
5. Payment
Payment is made when the order is handed over, on delivery or at the studio, in cash, by card or by bank transfer. No payment is taken online when the cart is submitted, and no card number is collected on this website.
For large orders, bespoke creations and services, a deposit may be requested; its amount is then specified in the confirmation. An invoice is provided on request.
6. Collection and delivery
Collection from the studio. Once confirmed, the order can be collected from the studio at 6 Rue Zemmour, Aviation district, Rabat, Monday to Saturday from 11am to 3pm or by appointment. Collection is free of charge.
Delivery. Areas served: all of Morocco. Delivery charge: 40 MAD. Usual lead time: 48 hours. The final lead time is given when the order is confirmed; barring force majeure, delivery takes place within this period.
Receipt. The customer checks the condition of the order on receipt. As plants are fragile, any problem (broken, damaged or non-conforming plant) must be reported to us within 48 hours of receipt, ideally with photographs, by email or WhatsApp.
7. Right of withdrawal
In accordance with Article 36 of Law No. 31-08, a customer acting as a consumer has seven (7) days from receipt of the order to exercise their right of withdrawal, without having to give a reason. They inform us in writing (email or WhatsApp), stating their order.
The product must be returned unopened, in good condition and in its original packaging, together with proof of order.
Live plants: Live plants are goods liable to deteriorate quickly, particularly in transit. In accordance with the exceptions provided by Law No. 31-08 for such goods, they are not covered by the right of withdrawal and are neither taken back nor exchanged because of a change of mind. A plant that arrives damaged will, however, be exchanged under the conditions of Article 6 (reported within 48 hours of receipt, with photographs).
Returns are made at the studio or by any other means agreed with us; any return costs are borne by the customer. We refund the amounts paid as soon as possible and no later than fifteen (15) days after receiving the returned product, using the same payment method or any other agreed method.
Creations made to order according to the customer’s specifications cannot be returned for a simple change of mind, to the extent permitted by law.
8. Non-conformity
If a delivered product does not match the order or is defective, the customer should contact us as soon as possible. We will then replace or refund the product, as circumstances allow. This provision does not cover damage resulting from unsuitable care or abnormal use after the product has been handed over.
9. Care and liability
We provide or publish care advice suited to each plant; following it is essential for the plant to settle in well. Some plants may be toxic if eaten by young children or pets: we are happy to answer any questions about this before you buy.
To the extent permitted by law, we cannot be held liable for damage resulting from unsuitable use or care of the product after it has been handed over, nor in the event of force majeure.
10. Workshops, events and courses
Registration for a workshop, event or course (including Les Petits Botanistes) is subject to the specific conditions shown on the relevant page — date, time, price, number of places, any deposit — and restated in the confirmation. Places are limited; we confirm each registration ourselves.
If we have to cancel or postpone an activity (too few participants, the facilitator being unavailable, force majeure), we inform participants as soon as possible and offer them a new date or a full refund of the amounts paid.
A minor child is registered by a parent or legal guardian, who guarantees the accuracy of the information provided, in particular any allergies or special needs we should know about.
Payment. A place is reserved on receipt of a 50% deposit, paid by bank transfer. The balance is paid on the day of the workshop, in cash or by card.
Cancellation by the participant. Any cancellation notified at least 48 hours before the workshop begins entitles the participant to a refund of the deposit. Within 48 hours, the deposit is retained.
11. Corporate gifts, projects and professional services
Corporate gifts, team-building workshops, planting projects, rentals, garden design and maintenance contracts are quoted on request. A quote accepted in writing constitutes the specific terms and prevails over these Terms in the event of any conflict. The right of withdrawal set out in Article 7 applies to consumers only.
12. Personal data
Data collected when you place an order is processed to manage that order, under the conditions described in our privacy policy.
13. Intellectual property
The texts, photographs and other elements of the website remain the property of the publisher, as stated in the legal notice. Buying a product confers no rights over these elements.
14. Force majeure
We are not liable for any delay or failure to perform caused by force majeure, meaning an unforeseeable and unavoidable event beyond our control (exceptional weather, transport disruption, decisions by the authorities, etc.). Our obligations are then suspended for the duration of the event.
15. Complaints
Complaints can be sent by email to tarik.zghinou@gmail.com, by phone or WhatsApp on 06 61 05 26 38, or made at the studio. We undertake to reply as quickly as possible.
16. Governing law and disputes
These Terms are governed by Moroccan law. In the event of a dispute, the parties will first seek an amicable solution. Failing that, and subject to the mandatory provisions applicable to consumers, the courts of Rabat have exclusive jurisdiction.
17. Changes to these Terms
We may amend these Terms at any time. The version that applies to an order is the one in force on the date of that order.
